Kayla Marie LaSala was a pretty little waif, barely over five feet tall, with, virginia Crime, cat-like green eyes and an alluring smile. She was fourteen and intelligent beyond her years. Like most teenagers, she could also be cunning and precocious. Yet she was still such a child! She never slept without her fluffy little black kitty. Kayla lived in Mercer County, West Virginia with her adoring father Steven LaSala. Kayla’s mother was no longer around, and Steven was raising his daughter alone.

Lately, it had become pretty, virginia Crime, difficult because the little angel could at times get a bit unruly. On February 23, 2004 the world found out that Kayla LaSala was also devious, virginia Crime, and deadly. She stabbed her father 108 times and calmly confessed to her crime. In spite of allegations of abuse on his part, LaSala was charged with first-degree murder as an adult and sentenced to 25 years. Pending her coming-of-age when she could, virginia Crime, actually start serving her sentence in adult prison, she was under house arrest, confined to her uncle’s home.

She was to wear an electronic ankle bracelet to monitor her every move, at all times. On July 3, 2004 police were notified that the monitoring device was disturbed. As it turned out, by the time, virginia Crime, they became aware of the problem, LaSala was long gone, having severed her anklet and attached this makeshift collar onto her kitty. However, her little cousin told the police Kayla left in a BMW, with an African-American male named Troy Gilmore whom she met in an online chat room. Kayla was now going by the name Tyragha McCala.

Police confronted Gilmore in Altomonte Springs, Florida, and he admitted to sheltering LaSala. She was found playing video games at his home. The above account is based on a true story. Background checks protect peaceful citizens from being deceived and/or harmed by a cunning criminal.

A non-profit Virginia based organization called “Truths in Justice” created a presentation regarding wrongful convictions and the truth behind this type of injustice. Let us start by reiterating some of the most common myths that people have about wrongful convictions.

- Everyone in prison claims to be innocent.

- People who live on the edge are the only ones charged with crimes they didn’t commit.

- The idea that people who were exonerated must have done something to get charged in the first place.

- Exoneration proves that the justice, virginia Crime, system works.

- The notion of it can’t happen to me.

According to research, almost 5% to 10% of the US prison, virginia Crime, population are factually innocent of the crimes they were convicted. What this means is that almost 200,000 convicts are innocent; 90% of which pled guilty of their crime. It has been assumed by the public in recent years that false accusations and wrongful convictions are only part of the unfortunate inconsistencies in a supposedly well functioning justice system.

It is also quite unacceptable for most of us why a suspect would plead guilty of a crime he/she didn’t actually commit. However through recent research here are the top reasons why wrongful convictions happen.

1. Eye Witness Error – This has been tagged as one of the primary reasons why wrongful, virginia Crime, convictions happen. Eye witnesses either suffer from confusion or faulty memory that’s why they end up convicting innocent people. Other times, the police are at fault for using illegal tactics to manipulate eye witnesses to accuse a target suspect.

There are sexual offenders living in typical neighborhoods all throughout the United States. Some live near schools, day care centers or the homes of people who may be viewed as potential targets for sexual predators.

The thought of living near a registered sex offender can be frightening, especially if you have young children. Some people are hoping the Supreme Court will support a law that will help keep sexual offenders out of their neighborhoods.

Civil Commitment is a law that gives every state the option to keep sexual offenders in custody after they have finished serving a prison sentence.

The offender is taken to a high security mental hospital immediately after their release. This could be a way to keep violent sexual offenders out of society indefinitely.

Members of the Supreme Court declared Civil Commitment to be Constitutional as long as the goal is to treat patients, not inflict punishment. Any state may choose to enforce this, and on January 12, 2010, the Supreme Court heard a case that called for the commencement of Civil Commitment on a Federal level.

As of 2010, nearly 20 states utilize Civil Commitment.

Currently, there are about 4,000 convicted pedophiles, rapists and other offenders confined in state-run mental facilities. Some of this is due to the efforts of a man named Martin Andrews, virginia Crime, .

When Andrews was only 13-years-old, he was approached by a stranger named Richard Ausley, who offered the boy money in exchange, virginia Crime, for help moving furniture. Ausley coaxed Andrews into his van, and drove deep into the country.

Andrews was successful. Virginia lawmakers backed his cause, and began enforcing Civil Commitment laws. The man who had tormented Andrews would not be set free.

Although Andrews agrees that Civil Commitment is not the best possible system for dealing with sexual offenders, he strongly advocates the law and says that it is “the only tool we have that is 100 percent effective, because they (sexual offenders) are removed from society.

” His goal is to help, virginia Crime, prevent other children from experiencing the torture he endured at the tender age of 13.

Education is a powerful tool, and it can help people protect themselves and keep their families safe. Parole means a person has completed a certain amount of their jail time and has the chance to complete the remainder of their time outside of jail. This is in place for individuals that have committed a serious crime.

When a person, virginia Crime, is released from jail and are on parole they will be supervised. Every state has their own laws in place for handling a person on this program and what is required of them. When a person is up for this review with the board there is no need for an attorney to be present.

The board is looking at everything including how the person acted throughout their jail term and then they will decide if this is even a possibility.

New York was the first state in the United States to use parole in 1876. It did not take long before all the states were using it for their inmates. Congress needed a way to evaluate and set release dates for the federal prisoners, so in 1910 the U.S. Parole Commission was set in place and given the responsibility.

When the board decides to let a person out of jail on parole they do not feel they are a threat to society.

The person is closely watched and it just takes one small incident and the person is finishing the rest of their time back in jail. Upon completing the program the person will be discharged and free to continue with their lives in the hopes they will stay out of trouble.

Parole does not mean the person is set free and has no, virginia Crime, obligations. The person might have to do some community service and could be charged a small monthly fee. The fee helps pay for their supervision that is required.

There will be a minimum amount each month with a maximum amount that the fees will not go over. Not all states have the same rules for probation and charging fees. No matter what state is doing the actual program they all agree on the same thing. This does not mean the parolee will, virginia Crime, have a shorter sentence then what the judge ordered. The person will have to complete all assigned time; they are just finishing the sentence outside of jail.

Truth in sentencing has become known in a, virginia Crime, few states since the 1970s.

This means that how ever long a person is sentenced to jail time the complete sentence will be served behind bars. The state of Virginia uses the truth in sentencing when dealing with felonies. If a person is convicted of a felony they will not be eligible for probation at any time while they are serving time, virginia Crime, in jail.

Parole is used for people that have committed serious crimes and have filled at least half their sentence in jail. If a person is in jail it actually depends upon which state they are sitting in and what laws the state has in place for the program.
